Conditions governing the use of IQ Certify and its services.

IMPORTANT NOTICE: THIS IS A SUBSCRIPTION SERVICE THAT RENEWS AUTOMATICALLY. PLEASE READ SECTION 7 “PAYMENTS AND SUBSCRIPTIONS” CAREFULLY BEFORE STARTING A TRIAL OR COMPLETING A PURCHASE. TO AVOID CHARGES, YOU MUST ACTIVELY CANCEL YOUR SUBSCRIPTION OR TRIAL PERIOD AT LEAST 24 HOURS BEFORE THE END OF THE TRIAL PERIOD OR THE CURRENT SUBSCRIPTION PERIOD.
THESE TERMS CONTAIN IMPORTANT DISCLAIMERS (SECTION 2), WARRANTY LIMITATIONS (SECTION 10), LIMITATIONS OF LIABILITY (SECTION 11) AND, FOR U.S. USERS, BINDING ARBITRATION PROVISIONS AND A CLASS ACTION WAIVER (SECTION 13).
1.1 These Terms and Conditions of Use (the “Terms”) govern the use of the website located at iq-certify.com (the “Website”) and the related assessment, test and content services (collectively, the “Services”) provided by ATENCION AL CLIENTE 24 HORAS S.L., a company registered under number B16642795, with registered office at Carrer del Fluvià, 1, BAJOS, 07009 Palma, Spain (hereinafter “IQ Certify”, “we”, “our”).
1.2 These Terms constitute a legally binding contract between IQ Certify and you. Please read them carefully before using the Services.
1.3 We also recommend that you review our Privacy Policy and Subscription and Refund Policy, the terms of which are incorporated herein by reference.
1.4 We may modify these Terms at any time. Modifications will be published on this page, indicating the “Last updated” date. For material changes, we may notify you by email or through notifications within the Services, but we are not obligated to do so in all cases. Continued use of the Services after a modification constitutes acceptance of the modified Terms. If you do not agree, you must stop using the Services.
1.5 IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, OR IF YOU DO NOT MEET THE CONDITIONS TO BE BOUND BY THEM, DO NOT ACCESS OR USE THE SERVICES.
WE DO NOT OFFER OR PROVIDE ANY KIND OF MEDICAL, PSYCHOLOGICAL, CLINICAL OR HEALTHCARE ADVICE, INCLUDING WITHOUT LIMITATION: DIAGNOSIS, ASSESSMENT, PROCEDURE OR THERAPY RELATED TO MENTAL OR PHYSICAL HEALTH. IF YOU HAVE ANY HEALTH PROBLEM, YOU SHOULD VISIT, CALL OR CONSULT YOUR DOCTOR OR OTHER AUTHORIZED HEALTHCARE PROFESSIONALS.
THE INFORMATION, TESTS, ASSESSMENTS AND CONTENT PROVIDED THROUGH THE SERVICES ARE FOR ENTERTAINMENT AND EDUCATIONAL PURPOSES ONLY. THE RESULTS OF OUR TESTS ARE NOT PROFESSIONAL PSYCHOLOGICAL TOOLS, ARE NOT EQUIVALENT TO AN OFFICIAL CLINICAL OR PSYCHOMETRIC ASSESSMENT, AND MUST NOT BE USED TO MAKE ACADEMIC, PROFESSIONAL, MEDICAL OR LEGAL DECISIONS.
RESULTS MAY BE AFFECTED BY MULTIPLE FACTORS INCLUDING ENVIRONMENTAL CONDITIONS, PHYSICAL AND MENTAL STATE, TIME OF DAY, TEST ENVIRONMENT, DEVICE AND CONNECTION, STRESS LEVEL AND FAMILIARITY WITH THE FORMAT. WE DO NOT GUARANTEE THE ACCURACY, RELIABILITY OR SCIENTIFIC VALIDITY OF THE RESULTS FOR ANY SPECIFIC PURPOSE.
ANY TESTIMONIALS AND EXAMPLES THAT MAY APPEAR IN THE SERVICES REPRESENT EXCEPTIONAL RESULTS THAT MAY NOT APPLY TO AN AVERAGE USER, AND ARE NOT INTENDED TO GUARANTEE THAT ANYONE WILL ACHIEVE THE SAME OR SIMILAR RESULTS.
FOR A VALID PROFESSIONAL ASSESSMENT OF INTELLIGENCE QUOTIENT, PERSONALITY OR ANY OTHER COGNITIVE ABILITY, YOU SHOULD CONSULT A DULY QUALIFIED AND LICENSED PSYCHOLOGIST OR PROFESSIONAL.
3.1 To use the Services, you must be at least 18 YEARS OF AGE, or the legal age of majority in your jurisdiction of residence, whichever is greater. By using the Services, you represent and warrant that you meet this requirement. The Services are not directed to minors and we do not knowingly collect data from minors.
3.2 To access certain features, it may be necessary to create a user account (“Account”) by providing truthful, accurate, current and complete information.
3.3 When registering, you represent and warrant that: (i) all information provided is truthful and accurate; (ii) you will keep such information up to date; (iii) your use of the Services does not violate any applicable law or regulation or these Terms.
3.4 Only one account per user is permitted. Sharing credentials, creating multiple accounts or using false information is not permitted.
3.5 You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use or suspected compromise of your account at [email protected].
3.6 We reserve the right to suspend or terminate your Account, with or without prior notice, in the event of a breach of these Terms.
3.7 By using the Services, you agree to receive communications from IQ Certify related to the service, including transactional emails, technical notifications, billing reminders and management emails. You may unsubscribe from non-essential marketing communications by following the unsubscribe link in the footer of each email.
4.1 IQ Certify offers an online platform of tests and assessments of an educational and entertainment nature, including without limitation: intelligence quotient (IQ) tests, personality tests, vocational tests, emotional intelligence tests, couple compatibility tests, cognitive ability tests, and related self-knowledge content.
4.2 Your access to and use of the Services is at your own risk. We are not responsible for any damage to your computer system, loss of data, or any other harm resulting from accessing or using the Services.
4.3 You are responsible for obtaining the equipment and telecommunications services necessary to access the Services, as well as all associated fees (equipment, internet provider, mobile data).
4.4 We reserve the right to implement changes to the Services (both in free and paid features) at any time, without prior notice and without any liability. You acknowledge that various actions on our part may prevent or limit access to the Services temporarily or permanently, without this giving rise to any liability of IQ Certify.
4.5 We have no obligation to provide you with customer support of any kind. However, IQ Certify may provide you with customer assistance from time to time, at its sole discretion, through the email [email protected].
5.1 All content of the Services, including without limitation text, images, trademarks, logos, compilations, data, software, assessment algorithms, test questions, generated reports, graphics and materials (excluding User Content as defined below), is the exclusive property of IQ Certify or of third-party licensors and is protected by international intellectual property laws.
5.2 IQ Certify expressly reserves all rights, including all intellectual property rights. Except as expressly permitted in these Terms, any use, redistribution, sale, decompilation, reverse engineering, disassembly, translation or any other exploitation is strictly prohibited. The provision of the Services does not transfer to you or to any third party any right, title or interest in such intellectual property rights.
5.3 The information you provide to us as part of your registration, as well as any data, text and material you submit or post (“User Content”) remains your intellectual property, and we do not claim ownership of the copyright or other proprietary rights to such registration information and User Content. Notwithstanding the foregoing, you agree that IQ Certify may retain copies of all registration information and User Content and use such information as reasonably necessary or incidental to the operation of the Services.
5.4 You hereby grant IQ Certify a non-exclusive, worldwide, royalty-free, transferable, perpetual and irrevocable license to publish, distribute, publicly display and process the User Content in connection with the Services.
5.5 Subject to these Terms, IQ Certify grants you a non-transferable, non-exclusive and revocable license (without the right to sublicense) to use the Services solely for personal and non-commercial purposes.
6.1 By using the Services, you agree not to:
6.2 If you provide false, inaccurate, outdated or incomplete information, we have the right to refuse any current or future use of the Services.
7.1.1 We offer a trial period (“Trial”) of 7 days for a one-time price of EUR 1.95. During the Trial, you will have access to the features described at the time of purchase.
7.1.2 At the end of the Trial, unless previously canceled, your subscription will automatically convert into a recurring subscription at the price of EUR 39.99 every 28 days (the “Subscription”), which will be charged automatically to your registered payment method at the start of each billing period.
7.1.3 Prices may be displayed in your local currency through applicable conversion. The exact price will be clearly displayed during the payment process. Taxes may apply depending on jurisdiction.
7.2.1 By starting the Trial, you expressly authorize IQ Certify (and our payment processors) to charge the Trial price and, subsequently, to automatically charge the monthly Subscription price to your registered payment method, including any applicable tax, until you cancel the Subscription in accordance with these Terms.
7.2.2 The date of the first Subscription charge will be the day following the end of the Trial period. Subsequent charges will be made every 28 days from that date.
7.3.1 THE SUBSCRIPTION RENEWS AUTOMATICALLY AT THE END OF EACH MONTHLY PERIOD, AT THE THEN-CURRENT PRICE. BY ACCEPTING THESE TERMS, YOU AUTHORIZE SUCH RENEWALS.
7.3.2 To avoid charges, you must cancel your Trial or Subscription AT LEAST 24 HOURS BEFORE the end of the current period (Trial or monthly). The cancellation will take effect at the end of the current period, with no proportional refund for unused days.
7.3.3 You may cancel your Subscription through:
7.3.4 Cancellation requests received by email will be processed within a maximum period of 3 business days. We will confirm the cancellation by email. IT IS YOUR RESPONSIBILITY TO VERIFY THAT YOU HAVE RECEIVED THE CANCELLATION CONFIRMATION.
7.3.5 Deleting your account without expressly canceling the Subscription does NOT cancel the recurring charges.
7.4.1 We reserve the right to modify the Subscription prices at any time, with reasonable prior notice through publication on the Website or notification by email. If you do not agree with the new price, you may cancel before it takes effect.
7.5.1 The renewal rate will not be higher than the rate of the previous period, excluding promotional prices and discounts, unless we notify you of a change before the renewal.
7.6.1 If your payment method is declined, we may make multiple charge attempts over a period of up to 7 days. Account benefits may be suspended 3 days after the payment failure. Bank charges arising from declined payments are your responsibility.
7.7.1 PAYMENTS MADE ARE NOT REFUNDABLE FOR UNUSED SUBSCRIPTION PERIODS ONCE CANCELED. The service will continue to be available until the end of the current billing period.

7.8.1 For users resident in the European Union: In accordance with Article 16(m) of Directive 2011/83/EU on Consumer Rights and the applicable national legislation, YOU EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THE CONTRACT AND ACKNOWLEDGE THAT YOU WILL LOSE YOUR 14-DAY RIGHT OF WITHDRAWAL ONCE THE PERFORMANCE OF THE SERVICE BEGINS, THAT IS, ONCE YOU ACCESS THE DIGITAL CONTENT OR TAKE YOUR FIRST TEST.
7.8.2 By confirming the start of the Trial and beginning to use the Services, you expressly acknowledge and accept this waiver. Therefore, you will not be entitled to a refund once the performance of the Service has begun, unless the digital content is defective or the mandatory provisions of your national legislation indicate otherwise.
8.1 The Services may contain links to third-party websites or resources and third-party advertising (collectively, “Third-Party Ads”). Such Ads are not under the control of IQ Certify and we are not responsible for them.
8.2 Your transactions with Third-Party Ads, including payment for and delivery of goods or services, are solely between you and that merchant or advertiser.
8.3 Payments through the Services are processed by third-party payment processors, including without limitation Stripe, Inc. (Stripe Payments Europe, Ltd. for users in the European Union) or other authorized processors. By making a payment, you accept the terms of use and privacy policies of such processors. We do not store complete payment card information.
8.4 You hereby release us, together with our officers, employees, agents and successors, from any claim, demand, loss, damage, right, claim and action of any kind, including personal injury, death and property damage, that is directly or indirectly related to or arises from any interaction with the conduct of Third-Party Ads.
You hereby agree to indemnify and hold harmless IQ Certify, its officers, directors, employees and agents, and its affiliated and related entities, against any claim, dispute, costs, losses, liabilities, damages, expenses and judgments of any kind (including, without limitation, reasonable attorneys' and accountants' fees) arising out of or connected in any way with: (a) your access to or use of the Services, (b) your User Content, or (c) your breach of these Terms.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING, WE EXPRESSLY DISCLAIM ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NON-INFRINGEMENT, AS WELL AS ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE ON AN UNINTERRUPTED, SECURE OR ERROR-FREE BASIS. WE DO NOT WARRANT THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY INFORMATION OR CONTENT IN THE SERVICES.
THE USE OF THE SERVICES IS AT YOUR SOLE RISK.
11.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER IQ CERTIFY NOR ITS SERVICE PROVIDERS INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THE SERVICES WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, NOR FOR DAMAGES FOR LOSS OF PROFITS, REVENUE, SAVINGS, BUSINESS OPPORTUNITIES, LOSS OR CORRUPTION OF DATA, SERVICE INTERRUPTION, DAMAGE TO COMPUTER SYSTEMS, NOR COSTS OF SUBSTITUTE SERVICES OF ANY KIND, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED.
11.2 OUR MAXIMUM TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF THE SERVICES WILL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO IQ CERTIFY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR ONE HUNDRED EUROS (€100), WHICHEVER IS LESS.
11.3 We expressly exclude any liability for:
11.4 This limitation applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, warranty or any other legal theory, and even if IQ Certify has been advised of the possibility of such damages.
IQ Certify does not warrant that the Services are accessible, appropriate or legally available for use in your jurisdiction. Access to the Services is prohibited from territories where their use is illegal. You access them on your own initiative and are responsible for compliance with local laws.
For users resident in the U.S.: You and IQ Certify agree that any dispute, claim or controversy arising out of or related to these Terms or to the use of the Services (“Disputes”) will be resolved exclusively through binding individual arbitration and not in a class, representative or consolidated action.
Either party may: (i) bring qualifying claims before a small claims court; (ii) seek injunctive relief to prevent infringements of intellectual property rights.
The arbitration will be conducted in accordance with the then-current Consumer Arbitration Rules of the American Arbitration Association (AAA). Hearings will be held in the county where the user resides, unless otherwise agreed.
YOU AND IQ CERTIFY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING. If this specific provision is found to be unenforceable, the entirety of Section 13 will be null and void.
This Section 13 does NOT apply to users resident in the European Union, to the extent that the applicable European or national legislation prohibits mandatory arbitration clauses or class action waivers in contracts with consumers. EU users may bring claims before the competent courts of their country of habitual residence.
14.1 These Terms will be governed by and interpreted in accordance with the laws of Spain, excluding its conflict-of-laws rules.
14.2 Any legal action related to any Dispute that, for any reason, is not submitted to arbitration, will be submitted to the exclusive jurisdiction of the courts of Spain. The parties irrevocably waive any defense of improper venue or forum non conveniens.
14.3 EU residents: Nothing in these Terms will deprive you of the protection that the mandatory rules of the law of the country where you reside grant you as a consumer. If you believe your claim is not adequately addressed, you may turn to the European Commission's Online Dispute Resolution (ODR) platform, accessible at: https://ec.europa.eu/odr. Except as established in these Terms, IQ Certify does not participate in any alternative dispute resolution scheme.
14.4 For residents of Spain: In accordance with the General Law for the Protection of Consumers and Users, you may exercise your rights before the courts of your domicile.
We may transfer or assign any and all of our rights and obligations under these Terms to any other person, including by novation. You may not assign these Terms without our prior written consent.
16.1 The failure or delay in exercising any right on our part will not constitute a waiver of such right.
16.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be reformed to reflect the intention of the parties to the maximum extent permitted by law.
16.3 These Terms, together with the Privacy Policy and the Subscription and Refund Policy, constitute the entire agreement between you and IQ Certify with respect to the subject matter hereof.
16.4 All communication through the Services or email is considered electronic communication. You accept the use of electronic signatures, contracts and records. By clicking buttons such as “ACCEPT”, “CONTINUE”, “PURCHASE”, “REGISTER” or similar, you are providing a legally binding electronic signature.
16.5 FORCE MAJEURE: We will not be liable for any breach of these Terms to the extent that such breach is due to factors outside our reasonable control, including natural disasters, governmental actions, war, terrorism, cyberattacks, pandemics, network failures, internet provider outages, or other circumstances outside our control.
